These Terms govern your use of the Tiny Writer AI desktop app and the website tinywriterai.com (together, the “Service”). By creating an account or using the Service, you agree to them.

Tiny Writer AI is a product operated by Coding With Purpose, a micro-entreprise registered in France under SIREN 801 136 490 (“we”, “us”, “our”). Our full details are in the Legal Notice. “You” means the person using the Service. How we handle personal data is described in our Privacy Policy.

1. The Service

Tiny Writer AI is an app for macOS and Windows that rephrases or explains text you select in any application, using AI models run by third-party providers. The Service is in beta: it will change as we improve it, and some features may be added, changed or removed.

2. Your account

You sign in with your email address and a one-time code. You must be at least 16 years old to use the Service. You're responsible for keeping access to your email address secure and for what happens under your account. An account is for one person; don't share it.

3. The free plan

The Service is free to use up to a daily limit on the number of requests. New accounts get a higher limit for their first few days. When you reach the limit, the app tells you when it resets. We may change the free plan's limits; the current limits are always shown in the app.

4. The Pro subscription

Price and payment

Pro costs $5.99 a month, including applicable taxes, and gives you a higher daily limit and extra features such as tone presets. The price you'll pay, in your local currency where available, is shown at checkout before you confirm.

Pro is sold through Stripe, which acts as the merchant of record: Stripe is the seller for the payment, collects your payment details, and handles tax, receipts and payment disputes. Your purchase is also subject to Stripe's terms, shown at checkout.

Renewal

Your subscription renews automatically each month, charged to your saved payment method, until you cancel. If a payment fails, Stripe will retry it for a period. You keep Pro while it retries, and your account moves back to the free plan if the payment still doesn't go through.

Cancelling

You can cancel at any time from “Manage subscription” in the app. Pro stays active until the end of the period you've paid for, and you won't be charged again.

Refunds

Payments are not refunded for partial months or unused requests, except where the law requires it. Nothing in these Terms limits the rights you have as a consumer, including any statutory right of withdrawal. If you think you're owed a refund, write to info@tinywriterai.com and we'll sort it out with Stripe.

Price changes

If we change the price of Pro, we'll tell you at least 30 days before your next renewal at the new price. You can cancel before then if you don't want to continue.

5. Acceptable use

You agree not to:

• use the Service for anything illegal, or to create content that is unlawful, harassing or infringes someone else's rights;
• get around the usage limits, for example by creating several accounts or sharing one;
• create an account by automated means or with a false identity, or pretend to be someone else;
• call our server from anything other than the Tiny Writer AI app, or automate requests to it;
• scrape or automatically collect data from the website or the Service;
• resell or give others access to the Service;
• copy, decompile or reverse-engineer the app or the server, except where the law allows it;
• send viruses or other malicious code, or do anything that puts an unreasonable load on the Service;
• interfere with the Service or try to access data or systems you're not authorised to access.

6. Your content

The text you select and the results you get back are yours. We don't claim any ownership of them. You give us permission to process your text only to provide the Service, as described in the Privacy Policy. We don't store it, and we don't use it to train AI models. You're responsible for having the right to use the text you submit.

7. Feedback

If you send us feedback, ratings or suggestions, you allow us to use them freely to improve and promote the Service, without owing you anything. This permission is non-exclusive, worldwide and lasts as long as the rights in your feedback do. You're still free to use your own ideas however you like.

8. AI results

Results are produced by AI models and can be inaccurate, incomplete or unsuitable for your purpose, and explanations can be wrong. Read a result before you use it. The Service doesn't give professional advice, whether legal, medical, financial or otherwise, and you are responsible for what you send or publish.

9. Our intellectual property

The app, the website and the Tiny Writer AI name and logo belong to us. We give you a personal, non-exclusive, non-transferable licence to install and use the app on your own devices for as long as you have an account and follow these Terms.

10. Updates and availability

The app updates itself so you have the latest fixes. We work to keep the Service available, but we don't guarantee that it will always be available or free of errors. It may be paused for maintenance, when a provider we rely on has an outage, or for the rest of the day if the service's daily AI cost limit is reached.

11. Ending your use

You can stop using the Service at any time, and you can ask us to delete your account by writing to info@tinywriterai.com. Cancel any Pro subscription first. We may suspend or close an account that seriously or repeatedly breaks these Terms. Where reasonable, we'll warn you first and give you a chance to fix it. If we close the Service, or your account without you having broken these Terms, we'll refund any unused part of a Pro period you've paid for.

12. Disclaimer

To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind. This doesn't affect the legal guarantees you have as a consumer, including the guarantee of conformity for digital services.

13. Limitation of liability

If you use the Service as a consumer, we're liable to you as consumer law provides, and nothing in this section reduces that. As French law sets out, we're liable for losses that are a direct and foreseeable result of our failing to meet our obligations.

If you use the Service for your business or profession, then to the extent the law allows, we're not liable for indirect or consequential losses, such as lost profits, lost data or lost business, and our total liability to you for any claim related to the Service is limited to the amount you paid for Pro in the month before the claim arose.

Nothing in these Terms limits liability for gross negligence, wilful misconduct, death or personal injury, or any liability that can't be limited under applicable law.

14. Governing law and disputes

These Terms are governed by French law. If you're a consumer in the EU, you also keep the protection of the mandatory consumer law of your country of residence. If you have a problem, please contact us first at info@tinywriterai.com. Most issues can be solved that way. Failing that, the courts of France have jurisdiction, although as a consumer you can also bring a claim in the courts of your country of residence.

15. Changes to these Terms

If we make material changes, we'll tell you by email or with a notice in the app at least 30 days before they take effect. If you keep using the Service after that, the new Terms apply. If you don't agree, you can stop using the Service and cancel any subscription.

16. Electronic communications

We'll contact you by email, at the address on your account, or with a notice in the app, for example about your account, your subscription or changes to these Terms. You agree that these Terms, notices and other communications can be given to you electronically, and that this meets any legal requirement for them to be in writing.

17. General

• These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
• If we don't enforce one of these Terms straight away, we can still enforce it later.
• If a court finds part of these Terms invalid, the rest still applies.
• We may transfer these Terms to another business, for example if Tiny Writer AI is sold, as long as this doesn't reduce your rights under them. You may not transfer your account or these Terms to someone else.
• We're not responsible for delays or failures caused by events beyond our reasonable control that count as force majeure under French law.
